This privacy notice (“Notice”) describes what information we collect and how we use, disclose, and otherwise process that information. This Notice describes how we collect, process, retain, and disclose personal information about you when providing services to you through our website (https://www.clairvoyantresearch.com), and in connection with our products, research activities, and other services, as well as from you when you interact with us on phone or video calls, at events, as part of programs we sponsor, or in other contexts; and from “third party” sources, in each case that link to this Notice or in the course of managing our knowledge base and consideration of new experts, as described below (our "Services"). It does not apply to information collected through any other means, including on any other website operated by a third party that does not link to this Notice; or any third party, including through any application or content that may link to or be accessible from or through the Services. 


Please read this notice carefully to understand our policies and practices regarding your information and how we treat it. By using or otherwise interacting with our Services or providing us with your information, you acknowledge that you have read this Notice. Where we rely on your consent for a particular processing activity, you may withdraw your consent at any time. This Notice may change from time to time (see Changes to Our Privacy Notice). If we make material changes, we will post the updated Notice, update the “Last Updated” date, and we will provide additional notice where required by applicable law. Your continued use of the Services after we make changes as described here is deemed to be acceptance of those changes, so please check the Notice periodically for updates.

The Personal Information That We Collect or Process


Personal information” (and, where applicable, “personal data” under the GDPR/UK GDPR/Swiss FADP) means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual, or that otherwise relates to an identified or identifiable natural person (for example, identifiers such as an IP address, cookie identifier, or device identifier). Personal information does not include deidentified or aggregated data that cannot reasonably be used to infer information about, or otherwise be linked to, a particular individual.

 

If we combine deidentified, anonymized, or aggregated data with Personal Information so that it directly or indirectly identifies an individual, we treat the combined information as Personal Information.


The types and categories of personal information we collect or process depend on how you interact with us and our Services and may include the categories below (as described in more detail in the How We Use Your Information and California Privacy Rights sections, and, where applicable, the European Economic Area / United Kingdom / Switzerland Privacy Rights section):

 

  • Identifiers, including names, email addresses, telephone numbers, physical addresses, IP addresses, device IDs, account IDs or authentication tokens/credentials, (and if you participate in recorded sessions) images, voice recordings, or video recordings that identify you;

  • Protected characteristics/demographics, including age, gender,  and other demographics you choose to provide (i.e., income level), as well as any voluntarily disclosed ethnicity, disability, or veteran status (if collected);

  • Commercial information, including payment method details, transaction and payment history, billing and invoice records, and payment status;

  • Internet or electronic activity, including usage data (i.e. site navigation, feature use, session logs), cookie data, pixels, analytics logs, login timestamps, clickstream, time-on-page metrics, email open and response rates, online survey engagement metrics;

  • Geolocation, including approximate general location inferred from IP address;

  • Professional/employment information, including employer, job title, company name, qualifications, work experience, expertise area (from onboarding or professional networking profiles), conflict-of-interest or vetting documentation;

  • Inferences, including research participation history, expert categorization or relevance scoring (e.g., field, expertise, reliability), segmenting users by usage patterns or interests; and

  • Sensitive personal information, where required for operations, such as tax identification numbers (e.g., Social Security numbers or ITINs for tax reporting) and payment account numbers. If you choose to provide information that may be treated as “special category” data under applicable law (e.g., racial or ethnic origin), we apply additional safeguards and process it only where permitted by law.


How We Collect Your Personal and Other Data


We collect Personal Information i) directly from you, ii) automatically when you visit our website or otherwise interact with our Services (including through cookies and similar technologies), and iii) from third parties and publicly available sources (for example, clients that refer potential experts, professional networking platforms, and verification/screening partners). We may also generate inferences or derived data from the information we collect. The sources and types of information we collect depend on how you interact with us (for example, as an expert, prospective expert, client, or website visitor). 


Information You Provide to Us

The Personal Information that you provide directly to us will be apparent from the context in which you provide it. For example:

  • Filling out forms: If you fill out a form on our sites, you may provide your name, contact details (postal address, email address, and telephone number), and other information requested by the form, such as the reason for your inquiry.

  • Communications: If you contact us or we contact you (i.e. by email, phone, text, or video), you may provide the content of your communications. If a call or session is recorded (for example, for research delivery or quality assurance), we collect the recording and any transcript or notes, where permitted by law and with any required notice/consent.

  • Participating in research: If you participate in a research interview or survey, you may provide professional details, demographic information, and your responses to interview or survey questions. Where required, we obtain consent for optional demographics and other information subject to heightened protections.

  • Payments and tax reporting (as applicable): if we pay you for participation, you may provide payment details and tax information, which may include a Social Security number or taxpayer identification number, needed for payment processing and tax reporting. 


Information We Collect Automatically

When you visit our website or interact with our Services, we and our service providers may automatically collect limited technical information to operate and improve the Services. This information may include identifiers and internet or other electronic network activity information, such as IP address, device identifiers, browser type, referring/exit pages, pages viewed, timestamps, log files, and cookie or pixel data. We use cookies and similar technologies for essential functions, such as security and fraud prevention, and for analytics. Where required by applicable law, we request your consent before placing non-essential cookies, and you can manage your choices through our cookie controls (if enabled) or browser settings.

 

We do not currently use third-party advertising technologies for cross-context behavioral targeting. However, we may enable such technologies in the future, for example, through platforms like LinkedIn, to reach relevant audiences or measure campaign effectiveness. If we do, we will update this Notice and provide a clear mechanism for you to opt out of such sharing, as required by applicable law.


Information We Receive from Third Parties and Publicly Available Sources

We may receive Personal Information about you from other sources and combine it with information we collect directly from you. These sources may include:

  • Clients and business partners that refer potential experts or research participants or provide business contact or professional background information in connection with engagements;

  • Publicly accessible online sources, such as professional profiles, company websites, or other sites that publish business contact or background information; and

  • Services providers that assist with screening, verification, fraud prevention or compliance, such as identity verification or conflict checking, where permitted by law. 


We use this information to identify, contact, and evaluate potential experts or research participants, to verify professional credentials and conflicts, prevent fraud, and to improve the quality and accuracy of our research. Where required by law, when we obtain personal data from sources other than you, we provide the required disclosures within the timeframes specified by applicable law.


How We Use Your Information


We  use Personal Information to operate our business, provide and administer our Services, communicate with you, conduct research and analytics, maintain and improve our systems, and to meet our contractual and legal obligations. Where applicable, we process Personal Information only where we have a valid legal basis: i) to perform a contract, ii) to comply with legal obligations; iii) with your consent (which you may withdraw at any time); and/or iv) for our legitimate interests (such as operating, securing, and improving the Services). Where we rely on legitimate interests, you may object, as provided in Your Rights and Choices section, including the right to object to direct marketing.


Specifically, we may use your personal information for the following business purposes:

  • Provide and Manage the Services, including administering and supporting the services, processing transactions and managing business relationships. 

  • Improve and secure our operations, including maintaining and enhancing the functionality, performance, and security of our systems; analyzing usage and operational data; and using interview feedback to refine workflows or AI tools.

  • Communicating with you, including responding to inquiries, providing support, sending service-related messages, and, where permitted, offering promotions or other marketing communications, consistent with your communication preferences. Where required by law, we obtain your consent for marketing; otherwise we rely on legitimate interests and provide an opt-out.

  • Conduct analytics and research, including analyzing usage trends, performing quality and performance reviews, and generating deidentified or aggregated insights to inform future research and product development.

  • Comply with legal and business obligations, including accounting, auditing, recordkeeping, and other internal administrative functions, such as handling privacy rights requests.


For these processing activities, we may use tools such as artificial intelligence and machine learning to process and analyze data. Where we use automated tools, including machine learning, we do not make decisions based solely on automated processing that produce legal effects or similarly significant effects on individuals. To the extent any automated processing is used in a way that would trigger additional rights under applicable law, we will provide the required notice and meaningful information and will offer a way to request a human review, express your view, and contest the decision. 


When we deidentify, aggregate, or anonymize data for purposes such as analytics, research, product development, and to improve our services, we endeavor to maintain and use the data in a deidentified, anonymized, or aggregated form such that it cannot reasonably be used to reidentify individuals, except as permitted by applicable law.


We use third-party analytics services in connection with our Services, including Google Analytics, to help us understand how visitors use the Services and to improve performance. Information collected through these services may be disclosed to or collected directly by the providers. Where required by applicable law, we request your consent before placing non-essential analytics cookies or similar technologies, and you can manage your preferences through our cookie controls. To learn more about their practices, please review their respective privacy policies. For example, you can learn about Google Analytics and opt out of its use in connection with your data here: https://tools.google.com/dlpage/gaoptout. We do not currently use third-party advertising services for cross-context behavioral advertising at this time. 


These analytics providers may track your online activities over time through cookies, web server logs, pixels, web beacons, and similar technologies. This data may include details about the actions you take, and your interactions with our content on our Services.


We use this information to understand usage trends, measure the performance of our Services and outreach, and improve the relevance of our communications. We do not use Google Analytics to serve cross-context behavioral advertising.


Our Services are not designed to respond to “Do Not Track” signals. We do not sell personal information or share it for cross-context behavioral advertising. If that changes, we will process recognized opt-out preference signals (such as the Global Privacy Control) as requests to opt out of sale/sharing, as required by applicable law.


Your Rights and Choices About Your Information


This section explains the choices and rights that may be available to you depending on where you live and how you interact with us. 

  • Marketing and Advertising. You can tell us at any time not to send you marketing communications by email by clicking on the “unsubscribe” link in the marketing emails you receive from us or by sending an “opt out” request to the address indicated on the email. 

  • Service-related Communications. Even if you opt out of marketing messages, we may still send you non-marketing communications that are necessary to provide the Services, for example, transactional notices, security alerts, or administrative messages.

  • Targeted Advertising. We do not currently use third-party advertising or tracking technologies for targeted or interest-based advertising. If we begin to do so, we will update this Notice and provide clear opt-out options as required by law. Depending on where you reside, you may have the right to opt out of the sale or sharing of your personal information for targeted advertising. 

    If we ever engage in “sale” or “sharing” of personal information for cross-context behavioral advertising (targeted advertising), you may be able to opt out through: (i) a “Do Not Sell or Share My Personal Information” link or other method we provide, and (ii) an opt-out preference signal such as the Global Privacy Control (GPC), where required by law. You may also learn about interest-based advertising choices through industry programs such as the Network Advertising Initiative (NAI) opt-out page; these tools are provided by third parties and their availability and effectiveness may vary.

  • Access, Correction, Deletion and Portability. Depending on your jurisdiction, you may have the right to request access to personal information we maintain about you, correct inaccurate information, delete personal information (subject to exceptions), and obtain a portable copy of certain information.

  • Opt out of certain processing. Depending on your jurisdiction, you may have rights to opt out of the sale of personal information, sharing for cross-context behavioral advertising/targeted advertising, and certain profiling. 

  • Limit use and disclosure of sensitive personal information (California). If you are a California resident and we use sensitive personal information for purposes that trigger the right to limit, you may request that we limit such use and disclosure as provided by law. 

  • Non-discrimination. We will not discriminate against you for exercising applicable privacy rights.

  • Authorized agent (California). California residents may use an authorized agent to submit certain requests on their behalf, subject to verification requirements. 

  • Appeals (certain U.S. states). Where required by applicable law, you may appeal our decision regarding your request by replying to our response or by emailing team@clairvoyantresearch.com with the subject line “Privacy Request Appeal.” 

  • EEA/UK/Switzerland rights. If the GDPR/UK GDPR or Swiss FADP applies, you may have additional rights, including to object to processing based on legitimate interests, withdraw consent, restrict processing, and lodge a complaint with a supervisory authority.


To exercise any of these rights (or to appeal a decision where an appeals process applies), please email team@clairvoyantresearch.com. We may need to verify your identity before responding, and we will respond within the timeframes required by applicable law. 


How We Protect Your Personal Information


We use commercially reasonable administrative, physical, and technical measures designed to protect your personal information from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal information transmitted to, through, using, or in connection with the Services. If we become aware of a security incident involving personal information, we will take reasonable steps to investigate, mitigate, and remediate it, and we will provide notices when required by applicable law.

 

In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Please do not send sensitive personal information, such as Social security numbers or financial account credentials to us by email or text unless we specifically request it and provide a secure method for doing so. 


The safety and security of your information also depends on you. Please take reasonable steps to protect your personal information (for example, use strong passwords where you maintain an account with us and notify us promptly if you suspect unauthorized access). 


How We Retain Your Personal Information


We retain Personal Information only for as long as necessary to fulfill the purposes described in this Notice, including providing the Services, conducting research, maintaining security, complying with legal obligations, resolving disputes, and enforcing our agreements. We apply retention periods below to the categories of Personal Information we collect or process. In some cases, we may retain information for longer where required or permitted by law, for example, to comply with tax, accounting, or litigation hold obligations.


Expert onboarding & vetting information (Identifiers; Professional/employment information; Inferences): 5 years after the later of (i) project close or (ii) last interaction

Why we retain it: To manage expert relationships, support repeat engagements, document conflict/quality controls, and handle disputes or contract enforcement.


Research content, such as survey responses, interview notes, and transcripts (Identifiers; Protected characteristics/demographics; Professional/employment information; Inferences; Sensitive personal information, only if collected): 5 years after the later of (i) project close or (ii) last interaction

Why We Retain It: To deliver research outputs, conduct quality review, and maintain an auditable record of research methodology and results.   


Audio/voice/video recordings (Identifiers; Protected characteristics/demographics; Professional/employment information; Sensitive personal information, only if collected): 12 months

Why We Retain It: To create transcripts/notes and support quality review while minimizing retention of raw recordings.

    

Identity verification & fraud-prevention records (Identifiers; Sensitive personal information, only if collected): Until the later of (i) verification / fraud prevention purpose is met or (ii) 3 years

Why We Retain It: To verify identity, prevent fraud, and maintain security and integrity of the Services. 


Expert payment & tax records (Identifiers; Commercial information; Sensitive personal information, only if collected): 7 years

Why We Retain It: To comply with tax and accounting obligations (including required reporting) and maintain financial records. 


Client billing and invoicing records (Identifiers; Commercial information): 7 years

Why We Retain It: To maintain business records and comply with accounting/tax obligations.


Product analytics & website usage data (Identifiers; Internet or electronic activity; Geolocation): 24 months

Why We Retain It: To understand usage trends, improve the Services, maintain operational logging, and support security monitoring.


At the end of the applicable retention period, we delete or destroy Personal Information, or deidentify it so it can no longer reasonably be linked to an individual. We may retain deidentified or aggregated information for longer periods for analytics or research, consistent with applicable law.

Certain jurisdictions provide individuals with specific privacy rights and require additional disclosures (for example, California; and, where applicable, the EEA/United Kingdom/Switzerland). Changes to Our Privacy Notice


We may update this notice from time to time, and we will provide notice of any such changes to the notice as required by law. The date the Privacy Notice was last updated is identified at the top of the page. We will notify you of changes to this notice by updating the "last updated" date and posting the updated notice on the Services. We may email or otherwise communicate reminders about this notice, but you should check our Services periodically to see the current notice and any changes we have made to it.

Third-Party Collection of Personal Information Online


We may allow certain service providers to collect internet or other electronic network activity information on our behalf to provide analytics and to help us operate and improve our Services. These service providers may collect information over time on our Services through cookies, pixels, log files, and similar technologies. The information collected may include pages viewed, actions taken, device and browser information, approximate location derived from IP address, and referrer information (for example, the website or source that brought you to our Services).


How We Have Used and Disclosed Personal Information for a Business Purpose


We may use (and may have used during the 12-month period prior to the Last Updated date of this CCPA Notice) your personal information for the purposes described in the section of our Privacy Notice titled How We Use Your Information. We do not use personal information for purposes other than those described in that section.


We do not collect or process sensitive personal information for purposes of inferring characteristics about consumers.


To the extent we process deidentified information, we will maintain and use the information in deidentified form and will not attempt to reidentify the information unless permitted by applicable law.


Personal Information That We May Have “Sold” or “Shared” with Third Parties


We have not sold or shared personal information for monetary consideration or for cross-context behavioral advertising in the preceding twelve (12) months. We do not have actual knowledge that we sell or share the personal information of minors under 16 years of age.


How Long We Retain Personal Information


We will retain your personal information as described in the How We Retain Your Personal Information section of our Privacy Notice.


Your Rights Under the CCPA


You have the following rights regarding your personal information:

  • Right to Access. You have the right to request, twice in a 12-month period, that we disclose to you the categories of personal information collected about you, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information collected about you.

  • Right to Delete. You may request that we delete personal information that we have collected from You.

  • Right to Correct. You may request that we correct inaccurate personal information that we maintain about You.

  • Right to Opt Out of Sales and Sharing. You have the right to opt out of the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising. Clairvoyant Research does not sell or share personal information as those terms are defined under the California Consumer Privacy Act, as amended by the CPRA. If this changes, we will update this Notice and provide a clear mechanism for you to exercise your opt-out rights, such as through a ‘Do Not Sell or Share My Personal Information’ link on our website.

  • Right to Non-Discrimination: If you choose to exercise any of your rights under the CCPA, you have the right not to receive discriminatory treatment by us. To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.


How to Submit a Request to Exercise Your Rights


To submit an access, correction, or deletion request, or to submit a request as an authorized agent on behalf of someone else, please email team@clairvoyantresearch.com.


How We Verify Your Request


To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your personal information or complying with your deletion or correction request. If you request access to, correction of or deletion of your personal information, we may require you to verify your email address or phone number in our records and/or provide any of the following information:

  • Full name and surname

  • State of residence

  • Physical address

  • Telephone number

  • Nature of your relationship with our company

  • Email address


In addition, if you ask us to provide you with specific pieces of personal information, we may require you to sign a declaration under penalty of perjury that you are the consumer whose personal information is the subject of the request.


Opt-Out Preference Signal


We do not sell personal information or share it for cross-context behavioral advertising. If that changes, you can opt-out of the sale or sharing of your personal information associated with a browser or device by broadcasting the Global Privacy Control (GPC) signal. Certain browsers and browser extensions support the GPC which sends a signal to the websites you visit indicating your choice to opt out from certain types of data processing, including the sale of your personal information and the sharing of your personal information for cross-context behavioral advertising purposes. If you want to use GPC, you can download and enable it via a participating browser or browser extension. More information about downloading GPC and supported browser can be found at https://globalprivacycontrol.org/. When we detect a GPC signal, we will automatically process the signal in a frictionless manner so as to respect your choices indicated by the GPC setting. Please note that your choices will apply only to the browser or device you are using when broadcasting the GPC signal to us. If you would like to opt out of the sale or sharing of your personal information associated with a different browser or device, please use the GPC signal on that browser or device to broadcast an opt-out request.


Notification of Material Changes to this Notice

Clairvoyant Research LLC is based in the United States. We may receive information directly from individuals located outside the U.S. (for example, when you communicate with us, participate in research, or use our website). We do not receive your personal data as an “export” from an EU/UK business customer acting as a separate controller; however, your personal information may be transferred to and processed in the United States when you provide it to us or when it is collected from sources described in this Notice.
